A.- INTRODUCTION
These specific terms and conditions of the online store operated by SMARTNET, SL (hereinafter: THE STORE) are provided as information prior to the purchase process and complement the general terms and conditions that govern the general use of the website accessible through https://shop.rfef.es/
Making any purchase through THE STORE necessarily implies acceptance of the general terms and conditions of access and use of the SMARTNET SL website, as well as these particular terms and conditions, without objection or reservation of any kind.
B.- GENERAL INFORMATION:
SMARTNET, SL (hereinafter: SMARTNET), is a Spanish company, registered in the Mercantile Registry of Madrid (Volume: 28,559 Folio: 97 Section: 8 Sheet: M-514169 Registration 1st), with CIF number: B-86133360 and registered office in Madrid (28010), c/ Fortuny, 51.
Any issues, complaints, or claims related to a purchase made in THE STORE must be communicated to the following email address: rfef@smart-keting.com
C.- ORDER PROCESSING:
Orders must be processed by THE STORE, where the user will be informed prior to the completion of each purchase of the exact amount of each of their orders, including the shipping costs associated with each one.
Only individuals aged 16 or older may place orders through THE STORE. Users of THE STORE guarantee that they are at least 16 years old and that all registration information provided to SMARTNET is accurate. In any case, the User will be solely responsible for any false or inaccurate statements made and for any damages caused to SMARTNET or third parties as a result of the information provided.
D.-PRODUCT AVAILABILITY:
THE STORE displays information on available stocks and sizes of products as communicated, in each case, by the manufacturer or distributor of the products.
SMARTNET makes efforts to keep this stock and size information updated based on the information transmitted at any given time by the manufacturer or distributor, but cannot guarantee its accuracy at all times because it is external information supplied by third parties.
Generally speaking, provided the desired product is available, shipments are made within 4-5 days, except in the case of products customized according to customer specifications, in which case, the shipment is made within 12/14 days after the order is formalized.
If for any reason it is not possible to supply any of the products included in an order, SMARTNET will contact the user as soon as possible to inform them of this circumstance and will proceed to refund the price of the product, as well as the shipping costs in the proportion to which the user is entitled according to the shipping cost tables published at any given time on the website.
In cases where it is not possible to supply an order consisting of one or more products due to the complete unavailability of all of them, SMARTNET will proceed to fully refund the amount paid for the order, including any shipping costs that may have been charged.
In cases where it is not possible to supply one or more products included in an order that comprises additional products that can be supplied, SMARTNET will proceed to fully refund the amounts paid for the unavailable products, but will retain the amounts corresponding to the price of the products that can be supplied, as well as the shipping costs associated with their delivery.
E.- GUARANTEES OFFERED:
THE STORE offers a guarantee on the products sold, under the legally established terms.
In any case and unless proven otherwise, the products will be considered to conform to the contract provided they meet all the requirements expressed below, unless due to the circumstances of the case one of them is not applicable:
- They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
- They should be suitable for the uses to which products of the same type are ordinarily put.
- They must be suitable for any special use required by the consumer and user when the consumer has made this known to the seller at the time of entering into the contract, provided that the seller has admitted that the product is suitable for such use.
- They must offer the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product.
In cases of proven product non-conformity with the contract, THE STORE will proceed - as appropriate and where applicable - to repair, replace, reduce the price or terminate the contract, actions which will be free of charge for the consumer and user.
F.- PRODUCT RETURNS - RIGHT OF WITHDRAWAL:
The user has the possibility of exercising their right of withdrawal on the purchase of products made in THE STORE within seven working days according to the calendar of their locality, from the receipt of the order at the chosen delivery address.
Product returns will only be accepted when the products are in perfect condition, have not been used, and retain their original labels, packaging, and –where applicable– original documentation and accessories, also in perfect condition.
Returns will not be accepted for products customized according to customer specifications or made to order. Likewise, for hygiene reasons, returns will not be accepted for underwear (including swimwear) or face masks.
SMARTNET reserves the right to deny the right to return products in cases of violation of the provisions of these particular conditions.
HOW TO EXERCISE THE RIGHT OF WITHDRAWAL:
To process product returns, you must -within fourteen business days of receiving the order- send an email to the following address: rfef@smart-keting.com a statement to that effect indicating the affected order number as well as the product or products subject to return.
If the return is approved and customer service tells you to do so, you must send the product(s) you wish to return to our facilities.
Each product to be returned must be in perfect condition, unused and with all its original labels, packaging and –where applicable– documentation and accessories that came with it.
Except in cases of receiving products with factory defects, and provided that such defects were not due to misuse or improper handling by the user, the shipping costs associated with the return will be the sole responsibility of the buyer. SMARTNET will refuse to accept any returns sent via cash on delivery.
Upon receiving the buyer's request to exercise their right of withdrawal and once in possession of the goods to be returned, SMARTNET will proceed to examine the products received and will contact you to inform you of its conclusions regarding your request.
In this case, refunds for returned products will be processed as soon as possible and, in any event, within thirty days of SMARTNET's receipt of the product , always subject to the provisions of these terms and conditions. Furthermore, in this case, the shipping costs initially charged on the order will be deducted from the total refund. If the customer benefited from a free shipping promotion and this promotion no longer applies to the order resulting from the return, the corresponding shipping cost (without the promotion) will be deducted from the refund amount.
For orders placed outside the Peninsula and Balearic Islands, the costs generated by the return of the order will be borne entirely by the customer, including export/import customs costs if the order is subject to them.
G.- PRODUCT RETURNS - MANUFACTURING DEFECTS:
The buyer has the option to return products received with a defect or factory flaw, within 24 hours of receiving the order.
Product returns will only be accepted when the products –with the exception of the alleged defect or flaw– are in perfect condition, have not been used and retain their original labels, as well as their packaging and –where applicable– original documentation and accessories, also in perfect condition.
SMARTNET reserves the right to deny the right to return products in cases of violation of the provisions of these particular conditions.
HOW TO MAKE RETURNS:
To proceed with returns of products with factory defects, you must -within 24 hours of receiving the order- send an email to the address: rfef@smart-keting.com stating the order number affected, as well as the product or products to be returned and a detailed list of the defects found in them.
SMARTNET will then contact you to arrange for the collection of the returned products from your home. With the exception of any defects or flaws found, each returned product must be in perfect general condition, unused, and with all its original labels, packaging, and—where applicable—documentation and accessories.
Except in cases of receiving products with factory defects, and provided that such defects were not due to misuse or improper handling by the user, the shipping costs associated with the return will be the sole responsibility of the buyer. SMARTNET will refuse to accept any returns sent via cash on delivery.
Upon receiving the request for return of a product with a defect or manufacturing flaw from the buyer and once in possession of the merchandise to be returned, SMARTNET will proceed to examine the products received and will contact you to inform you about its conclusions regarding your request.
Once a factory defect has been verified, and provided that the product has not been used and retains all its original labels, packaging and –where applicable– documentation and accessories that came with it, SMARTNET will proceed to process the replacement of the product with another of identical characteristics from the corresponding manufacturer or distributor.
If it is not possible to replace it, SMARTNET will inform the user of this circumstance and will proceed to refund the user the amount corresponding to the purchase of the product with the proven fault or factory defect.
In such cases, refunds for returned products will be processed as soon as possible and, in any event, within thirty days, subject to the terms and conditions set forth herein. Furthermore, in such cases, the return shipping costs will be borne by the user.
H.- REQUEST FOR PRODUCT EXCHANGES DUE TO SIZE ERROR
If the user wishes to exchange the product due to a size error, they must proceed to return it, exercising their right of withdrawal, under the cases and conditions indicated above.
