A.- INTRODUCTION
These particular conditions of the online store operated by SMARTNET, S.L. (hereinafter: THE STORE), are offered as prior information to the purchase process and complement the general terms and conditions that regulate the general use of the website accessible through https://shop.rfef.es/
Any purchase made through THE STORE necessarily implies the acceptance of the general terms and conditions of access and use of the SMARTNET S.L. website, as well as these particular terms and conditions, without objection or reservation of any kind.
B.- GENERAL INFORMATION:
SMARTNET, S.L. (hereinafter: SMARTNET), is a Spanish company, registered in the Commercial Registry of Madrid (Volume: 28,559 Folio: 97 Section: 8 Sheet: M-514169 Registration 1st), with CIF number: B-86133360 and registered office in Madrid (28010), c/ Fortuny, 51.
Any incident, complaint or claim related to a purchase made in THE STORE must be communicated to the email address: rfef@smart-keting.com
C.- ORDER PROCESSING:
Orders must be processed by THE STORE, where the user will be informed prior to the completion of each purchase of the exact amount of each of their orders, including the shipping costs associated with each of them.
Only persons at least 16 years of age may process orders through THE STORE. The User who uses THE STORE guarantees that they are at least that age and that all registration data provided to SMARTNET is accurate. In any case, the User will be solely responsible for any false or inaccurate statements made and for any damages caused to SMARTNET or third parties by the information provided.
D.- PRODUCT AVAILABILITY:
THE STORE displays stock information and available product sizes communicated, in each case, by the manufacturer or distributor thereof.
SMARTNET makes efforts to keep said stock and size information updated based on the information transmitted at all times by the manufacturer or distributor, but cannot always guarantee its accuracy as it is third-party information, supplied by others.
In general, whenever the desired product is available, shipments are made within 4-5 days, except in the case of personalized products based on customer specifications, in which case, the shipment is made within 12/14 days after the order is placed.
If for any reason it is not possible to supply any of the products included in an order, SMARTNET will contact the user as soon as possible to inform them of this circumstance and will refund the price of the product, as well as the shipping costs in the proportion to which the user is entitled according to the shipping cost tables published at any given time on the website.
In cases where it is not possible to supply an order composed of one or more products due to complete unavailability of all of them, SMARTNET will proceed to fully refund the amount paid for the order, including any shipping costs that may have been charged.
In cases where it is not possible to supply one or more products included in an order that comprises additional products that can be supplied, SMARTNET will proceed to fully refund the amounts paid for the unavailable products, but will retain the amounts corresponding to the price of the products that can be supplied, as well as the shipping costs associated with their delivery.
E.- WARRANTIES OFFERED:
THE STORE offers a warranty on marketed products, under the legally established terms.
In any case and, unless proven otherwise, products will be understood to conform to the contract provided that they meet all the requirements set out below, unless due to the circumstances of the case, any of them is not applicable:
- They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
- They are suitable for the uses to which products of the same type are ordinarily intended.
- They are suitable for any special use required by the consumer and user when they have informed the seller at the time of concluding the contract, provided that the seller has admitted that the product is suitable for such use.
- They show the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product.
In cases of proven non-conformity of the product with the contract, THE STORE will proceed - where appropriate and as applicable - to repair, replace, reduce the price or terminate the contract, actions that will be free of charge for the consumer and user.
F.- PRODUCT RETURNS - RIGHT OF WITHDRAWAL:
The user has the possibility to exercise their right of withdrawal on the purchase of products made in THE STORE within seven working days according to the calendar of their locality, from the receipt of the order at the chosen delivery address.
Product returns will only be accepted when the products are in perfect condition, have not been used and retain their original labels, as well as their packaging and - where appropriate - original documentation and accessory elements, also in perfect condition.
Returns of products personalized according to customer instructions or made to customer specifications will not be accepted. Likewise, for hygiene reasons, returns of intimate apparel - underwear and swimwear - or face masks will not be accepted.
SMARTNET reserves the right to deny the right to return products in cases of violation of what is established in these particular conditions.
HOW TO EXERCISE THE RIGHT OF WITHDRAWAL:
To proceed with product returns, you must - within fourteen business days following receipt of the order - send an email to the address: customers@smart-keting.com a statement to that effect indicating the affected order number as well as the product or products to be returned.
If the return is appropriate and customer service instructs you to do so, you must send the product(s) you wish to return to our facilities.
Each product to be returned must be in perfect condition, unused and with all its original labels, packaging and - where applicable - documentation and accessory elements that came with it.
Except in cases of receipt of products with manufacturing defects and, provided that such defects were not due to improper handling or use by the user, the shipping costs associated with the return will be borne exclusively by the buyer. SMARTNET will reject the receipt of any return made in "cash on delivery" mode.
Once the buyer's request to exercise their right of withdrawal has been received and once the returned merchandise is in its possession, SMARTNET will proceed to examine the received products and will contact you to inform you of its conclusions regarding your request.
Where appropriate, the refund of amounts paid for the purchase of the returned product will be carried out as soon as possible and, in any case, within thirty days following the receipt of the product by SMARTNET, always subject to the provisions of these particular terms and conditions. Likewise, in such case, the amounts initially charged for shipping costs in the order will be deducted from the total amount to be refunded. If the customer benefited from a free shipping promotion and this is no longer applicable to the resulting order upon return, the amount corresponding to said concept (without applying the promotion) will be deducted from the amount to be refunded.
For orders placed outside of the Peninsula and Balearic Islands, the costs generated by the return of the order will be fully borne by the customer, including customs export/import costs if the order is subject to them.
G.- PRODUCT RETURNS - MANUFACTURING DEFECTS:
The buyer has the possibility of returning products received with a flaw or manufacturing defect, within 24 hours following the receipt of the order.
Returns of products will only be accepted when they are - with the exception of the alleged defect or flaw - in perfect condition, have not been used, and retain their original labels, as well as their packaging and - where applicable - original documentation and accessory elements, also in perfect condition.
SMARTNET reserves the right to deny the right to return products in cases of violation of what is established in these particular conditions.
HOW TO MAKE RETURNS:
To proceed with returns of products with a manufacturing defect, you must - within 24 hours following receipt of the order - send an email to the address: customers@smart-keting.com a statement to that effect indicating the affected order number as well as the product or products to be returned and a detailed list of the defects found in them.
SMARTNET will then contact you to arrange for the collection of the returned products at your home. Except for the detected defect or flaw, each product to be returned must be in perfect general condition, unused and with all its original labels, packaging and - where applicable - documentation and accessory elements that came with it.
Except in cases of receipt of products with manufacturing defects and, provided that such defects were not due to improper handling or use by the user, the shipping costs associated with the return will be borne exclusively by the buyer. SMARTNET will reject the receipt of any return made in "cash on delivery" mode.
Once the buyer's request for return of a product with a flaw or manufacturing defect has been received and once the returned merchandise is in its possession, SMARTNET will proceed to examine the received products and will contact you to inform you of its conclusions regarding your request.
Once the existence of a manufacturing defect has been verified and provided that the product has not been used and retains all its original labels, packaging and - where applicable - documentation and accessory elements that came with it, SMARTNET will proceed to process its replacement with another of identical characteristics with the corresponding manufacturer or distributor.
If replacement is not possible, SMARTNET will inform the user of this circumstance and will refund the user the amount corresponding to the purchase of the product with the verified flaw or manufacturing defect.
In such case, the refund of amounts paid for the purchase of the returned product will be carried out as soon as possible and, in any case, within thirty days, always subject to the provisions of these particular terms and conditions. Likewise, in such case, the costs corresponding to the return shipment will be borne by the user.
H.- PRODUCT EXCHANGE REQUESTS DUE TO SIZE ERROR
If the user wishes to exchange the product due to a size error, they must proceed with its return, exercising their right of withdrawal, under the aforementioned assumptions and conditions.
